Applying for a partial building permit for the modification of an installation

Description

You need a partial building permit if you want to start with the partial modification of facilities before the actual building permit is granted.

To do this, you submit an application for a partial building permit to the responsible lower building supervisory authority. In the application, you specify which parts of the building you would like to start on before the permit is granted. The partial building permit for the modification of an installation is subject to a fee.

Prerequisites

You will receive a partial building permit for the modification of building structures if:

the building application is complete with regard to the changes requested for the partial building permit and
the public law regulations are complied with

If not yet submitted with the building application:
- Extract from the official real estate map
- site plan
- Construction drawings
- Building description

Fees (costs)

The fees for the partial building permit are: 50 to 1,500 €.

The costs depend on the following factors:

Time and effort required to check the partial building permit
Expected costs of the construction work

The fee for the partial building permit is offset against the fee for the building permit if the fee for the partial building permit is higher than €150.

Deadlines

You must start construction work within 3 years of receiving the partial building permit.

You may then interrupt the construction work for a maximum of 1 year.

You can have the partial building permit extended for 1 year.

Processing time

Processing Time: 0 - 3 Months
The deadline begins with the confirmed date of receipt. Exception: The building supervisory authority can extend the deadline by a maximum of 2 months if there is an important reason. If the deadline is extended, you will be informed, stating the reasons and the expected date of the decision.

Procedure

You can apply for a partial building permit for the modification of an installation via the online service or in writing.

If you apply in writing, proceed as follows:

Submit the application and state in it which building application your application for partial building permission relates to. Indicate which construction measures you would like to start early.
Attach the required building documents.
Submit the application documents to the responsible lower building supervisory authority.
If necessary, the lower building supervisory authority will ask you to make an advance fee payment.
Make the advance payment.
If documents are missing or there are other ambiguities, you will be asked to resolve these ambiguities.
In this case, submit the missing or amended documents or the clarification.
The lower building supervisory authority will review your application and involve the relevant authorities whose participation or consultation is required.
You will then receive a decision on your application and a fee notice.
Pay the fees.
