Display the construction and operation of a plant that does not require a permit or a modification relevant to an accident

Description

Do you operate a plant that does not require a permit under immission control law and is an operating area or part of an operating area and are planning a fault-relevant change to it?

Or are you planning the construction and operation of a plant that does not require a permit and that is an operating area or part of an operating area?

These projects can lead to a significant increase in the risk of the plant as a result of the construction or modification or other immission requirements are no longer guaranteed.

The immission control authorities must therefore be informed about these changes so that the immission requirements can be checked. To do this, you must register your project with the competent authority before implementation. Registration can be made in writing or electronically.

Prerequisites

The construction and operation of an installation relevant to an accident as well as a modification relevantto an accident must be notified to the competent authority if:

the installation is an installation that does not require a permit and is either an operating area or part of an operating area,
an accident-relevant construction and operation or modification relevant to the accident is planned, and
a permit has not already been applied for for a construction and operation relevant to an accident or the modification of a facility that does not require a permit.

An accident-relevant approval procedure for an installation that does not require a permit is required and must be applied for if:

The appropriate safety distance of the system is undercut for the first time,
is spatially undercut even further, or
a significant increase in risk is triggered.

Procedure

They notify the competent authority of the construction or modification of the installation or modification relevant to the accident before commissioning or before the implementation of your project.
You can do this with the help of the EliA service or in writing. You attach the required documents to the application.
The competent authority will confirm receipt of the notification and the attached documents. Where appropriate, the Authority shall request further and/or additional documents.
No later than two months after receipt of the notification and the complete documents, the competent authority will inform you whether your project is subject to approval or not.
If the competent authority informs you that no approval procedure is to be carried out, you, as the operator or promoter of the project, can carry out the construction and operation or the modification immediately after notification to the authority.
However, if the authority comes to the conclusion that your project requires a permit, you must then apply for approval for a construction or modification relevantto an accident.
